Golden Duplex: Adding Additional Legal Dwelling Units
One of the most common misconceptions about the Golden Duplex exemption is that adding another legal dwelling unit automatically eliminates the exemption.
It doesn't.
In April 2017, the Berkeley Rent Stabilization Board adopted Resolution No. 17-12 to clarify how the Golden Duplex exemption applies when additional legal dwelling units are constructed on a property.
Adding a Second Unit to a Single-Family Home
A single-family home does not become subject to Berkeley's rent registration and rent ceiling provisions simply because a second legal dwelling unit is added.
If the addition creates a duplex, the property may qualify for the Golden Duplex exemption, provided the original single-family home was occupied as the principal residence of an owner holding at least a 50% ownership interest on December 31, 1979, and the current owner-occupancy requirements are satisfied.
What Happens When Additional Units Are Added to a Golden Duplex?
The addition of a third or subsequent legal dwelling unit does not automatically eliminate an existing Golden Duplex exemption.
Instead, the exemption remains with the two original qualifying units, provided an owner of record holding at least a 50% ownership interest continues to occupy one of those units as their principal residence.
The additional legal dwelling unit does not become part of the Golden Duplex exemption.
The Exemption Is Limited to Two Units
Berkeley Municipal Code Section 13.76.050 limits the Golden Duplex exemption to two units.
Although additional legal dwelling units may be constructed on the parcel, the exemption remains associated with the original qualifying units. Any third or subsequent legal dwelling unit is not exempt under the Golden Duplex provision.
Example
Imagine a property that qualified as a Golden Duplex because the original duplex satisfied the historical and current owner-occupancy requirements.
Years later, the owner constructs a detached ADU.
The result is not three exempt units.
Instead:
- The two original qualifying units retain the Golden Duplex exemption, provided the owner-occupancy requirements continue to be met.
- The new ADU is evaluated independently under the applicable provisions of Berkeley's Rent Stabilization Ordinance.
