Think BPOA Costs Too Much? Consider the Cost of “Saving”
While staffing BPOA’s table at a recent Berkeley Rent Board Landlord Resource Fair, we heard the same explanation from multiple rental housing providers: they chose a lower-cost association because it promised “Berkeley” forms. We decided to find out what those savings actually bought.
Both housing providers believed they were receiving essentially the same resources BPOA provides, but for considerably less money. Their confidence was understandable. The other association’s website gave every indication that members would receive documents designed for their city.
After the event, we purchased a membership and reviewed the association’s “Berkeley” rental application, lease, and notice to pay rent or move out.
We were not impressed.
The documents contained outdated information, significant omissions, confusing provisions, and language that could point a Berkeley rental housing provider in the wrong direction. Materials referenced as part of the lease package were not actually provided. Important distinctions among Berkeley properties and tenancies were not adequately addressed.
This was not simply a matter of BPOA offering a more comprehensive product. Some of the materials we reviewed created the appearance of Berkeley compliance without providing the substance behind it.
A Lower Price Does Not Mean Comparable Value
When two associations advertise forms for Berkeley rental housing, it is easy to compare their membership prices and assume they provide roughly the same thing.
They may not.
A generic California document does not become a reliable Berkeley form merely because the city’s name appears at the top. Berkeley has an unusually complex and frequently changing combination of local ordinances, Rent Board requirements, voter-approved measures, and state laws.
A document can look official and still be incomplete or outdated. Unless you already know what should be included, you may have no reason to question it.
That is the danger. A housing provider may not discover that something is missing or incorrect until a tenant challenges the lease, a notice fails, or an otherwise manageable issue becomes a costly dispute.
